1. Parties
This User Agreement is between newbalance.com.tr (NBI Giyim A.Ş.) on the one hand and the User who is a member of the Site on the other side, in order for the User to become a member of the Site and in the electronic environment where the relevant Site is located, It is edited at the time of approval by the user. By becoming a member of the Site, the user accepts, declares and undertakes that he has read the entire User Agreement, fully understood its content and approved all provisions.
2. Definitions
User: Refers to the real or legal person who is a member of the website www.newbalance.com.tr and purchases the products / products offered for sale by the Site.
Product: Products put up for sale on the website www.newbalance.com.tr under the umbrella of NBI and NBI Giyim A.Ş. Refers to the brands within its structure.
Site: Refers to the website consisting of the domain name www.newbalance.com.tr.
3. Subject and Scope of the Agreement
The subject of the User Agreement is the determination of the Products offered on the Site, the conditions to benefit from these Products and the rights and obligations of the parties.
The scope of the User Agreement is all the statements such as warnings, writings and explanations made by the Site regarding the usage, membership and products and services contained within the Site with this agreement. By accepting the terms of the User Agreement, the User also accepts all kinds of statements made by newbalance.com.tr regarding usage, membership and products and services on the Site.
The user accepts, declares and undertakes to act in accordance with all matters specified in the aforementioned statements.
4. Membership and Site Terms of Use
a) The site mentioned in this contract is open to everyone. In order to be a member of the site, it is necessary to fill in the mandatory fields of the membership form completely. The User requesting membership accepts the accuracy of the information transferred to this form unconditionally. The user has a password to be set by himself. The e-mail address given during registration to the Site is specific to the User who is a Member. It is not possible to have two different subscriptions with the same e-mail address. The password is known only by the Member User. User can change password whenever wants to. The selection and protection of the password is entirely under the responsibility of the User.
b) newbalance.com.tr is not responsible for any problems arising from password usage. The user must enter the e-mail address and password he entered during registration in order to connect to the services that require Site membership.
c) In the following cases, the Site management may prevent the user who is a member from using the site and reserves the legal rights of the person or persons involved in the following attempts:
- In the event that information that contains false, irregular, incomplete and misleading information, statements that do not comply with general ethics and that do not comply with the laws of the Republic of Turkey are recorded on the site.
- In case the works and content on the site are partially or completely copied and used for different purposes or attempted to be used.
- In the event of using software that will threaten the general security of the site and prevent the operation of the site and the software used, in the event of activities, attempts to be carried out, and information retrieval, deletion, or modification.
5. Rights and Obligations
5.1 Rights and Obligations of the User
a) By purchasing the product (s) displayed on the Site, the user is deemed to have accepted the sales terms and procedures determined by newbalance.com.tr along with the product description.
b) The User, while performing the membership procedures, benefiting from the Services of the Site and performing any transaction related to the Services on the Site, must comply with all the terms in the User Agreement, the rules specified in the relevant parts of the Site and all applicable legislation. It accepts, declares and undertakes that it will act in accordance with the above-mentioned terms and rules.
c) The users are solely responsible for the security, storage, keeping away from third parties' information and use of the system access tools (User name, password, etc.) used by the users in order to benefit from the Services offered by newbalance.com.tr. Any liability of newbalance.com.tr, directly or indirectly, for the damages that users and / or third parties have suffered or may suffer due to all their negligence and faults in matters such as the security, storage, keeping away from third parties 'information, use of the users' login tools. there is no.
d) The user agrees, declares and undertakes that he will approve the preliminary information form and the distance sales contract prepared on the basis of the user information and the information given about the product subject to sale within the framework of the Law on Consumer Protection No.6502 and other legislation on the Site.
